
Related to the provision of business messaging services containing alphanumeric codes ("Alias") as senders ("Code")
This Code of Conduct is drafted under Article 5, paragraph 4, of the resolution by the Communications Authority (AGCom) 42/13/CIR 'Rules for the experimentation of alphanumeric indicators for identifying the caller in SMS/MMS used for corporate messaging services' and aims to regulate the establishment, assignment, and use of Aliases within corporate messaging services, as well as to define the rules for the protection of the users of these services.
Messaging services are provided by an authorized provider according to the Resolution in favor of a Client/Company, whether a natural or legal person, who intends to communicate with their End Customers through SMS or MMS messages to offer products or services, provide service information, or request responses to the messages sent.
Messaging services that involve sending a message to End Customers are commonly referred to as 'MT' type messaging services (Mobile-Terminated), while services that require a response from End Customers are called 'MO' type messaging services (Mobile Originated). MT services can use Aliases as an alternative to CLI (Calling Line Identification). This Code exclusively addresses corporate messaging services through the use of Aliases.
The Code aims to ensure the correct development of corporate messaging services, respecting the rights of Clients/Companies and End Customers, and promoting fair competition among sector players. Providers commit to adopting best practices to ensure correct use of Aliases by Clients/Companies.
Aliases consist of alphanumeric strings not exceeding 11 characters, as specified in Annex A of the Code.
The assignment of Aliases follows trademark laws. Konima.it ensures that only legitimate rights holders can use an Alias, through authentication procedures and contractual clauses obliging Clients/Companies to declare the legitimate use of Aliases.
The use of generic Aliases is permitted if the company's identity is clearly indicated in the message, according to the provisions of the Resolution.
These Aliases are exclusively reserved for Public Entities or Institutions.
Before use, Aliases must be loaded into a database managed by AGCom, with detailed information about the Client/Company, including name, VAT number or tax code, and a single contact among telephone number, fax, or email.
Aliases can only be used by Clients/Companies with active contracts with Konima.it and associated E.164 numbers, ensuring that each Client/Company has a unique number.
An Alias ceases to be active upon termination of the contract or at the explicit request of the Client/Company, with an update to the Alias System within 24 hours.
End Customers can report unwanted or deceptive messages to their operator, who, through the AGCom database, will provide detailed information about the sender, such as company name, Alias used, and contact details of the Client/Company.
Konima.it reserves the right to update this Code to enhance rights protection and meet market needs, in line with the evolution of corporate messaging services and related regulations.
